Q. Does The Lex Group guarantee court acceptance?
A. Yes. The Lex Group guarantees court acceptance of all documents filed.

THE DESIGNATION

Q. How can The Lex Group assist in the designation process?
A. The Lex Group notifies counsel of Petitions granted or records received by the courts. Filing dates and sample Designations (if requested) are then provided via facsimile. We forward the tables of contents from the record upon request to simplify the designation process. Finally, we hand file and serve court stamped copies of your designation. We then status the case daily for the filing of the AppelleeÕs designation so that the appendix preparation process can begin as quickly as possible.

THE APPENDIX

Q. Can The Lex Group obtain documents directly from the courts?
A. Yes. We have full access to the courts' records. Your Lex paralegal will copy designated materials directly from the court. Counsel may forward the designated materials to our office if preferred.

Q. What else will you do as far as the appendix is concerned?
A. The Lex Group handles all aspects of the Appendix. We generate the table of contents and cover. We denote breaks in transcript with triple asterisks and witness transcript pages per court requirements. The documents are paginated, duplicated and chesire bound into an appendix. An advance copy is forwarded to your office for approval. Appendices under 1000 pages are created in 24 hours. Only after your approval are final court and service copies made.

THE BRIEF

Q. What are the margin requirements for the brief?
A. Both courts require 6" linear text. The Lex Group formats all briefs received electronically to meet court requirements.

Q. Will The Lex Group generate the cover, Table of Contents and Table of Authorities for the brief?
A. Yes. The Lex Group provides covers for all briefs filed. We will generate the Table of Contents and a Blue Book compliant Table of Authorities (upon request). Please note, both Virginia courts require parallel sites in the Table of Authorities.

Q. When do you need briefs in order to guarantee timely filing?
A. We routinely receive briefs on the day of filing. Briefs received on the day of filing are generally sent via either priority overnight courier for morning delivery or via email.

We recommend a pre-review of all briefs to ensure compliance with the Code of Virginia. This is a complimentary service.

Q. Will the courts accept briefs filed out of time?
A. They will not. The timelines in the Virginia appellate courts are inflexible

Q. Will the courts consider Motions for Extension of Time?
A. Yes. We recommend filing of motions for extension as early as possible. Extensions are not granted routinely.

Q. What is the procedure in regards to service?
A. The Lex Group serves all documents, court-stamped, upon opposing counsel either by hand or U.S. mail on the day of filing per the Code of Virginia.
